Welcome to Webmania. By accessing our website, inquiring about our services, or engaging us for website design and development, you agree to comply with and be bound by the following Terms & Conditions. Please read them carefully.

✦ 1. Scope of Services

Webmania is a Website Design & Development Agency providing services including, but not limited to:

Business Websites, Portfolio Websites, Landing Pages, and Corporate Websites
Website Redesign and Maintenance
Website Consultation
Basic SEO Setup
Hosting and Domain Assistance

✦ 2. Project Process

STEP 1: Free Sample Website

Webmania may create a sample website layout based on your requirements.
This sample is shared for review purposes only, and you are under no obligation to proceed.
The sample website remains the intellectual property of Webmania until a formal project agreement is finalized.

STEP 2: Project Approval

Upon approval of the sample website, a 50% advance payment is required to officially commence the project.
The estimated project timeline will be shared at this stage.

STEP 3: Development Phase

The website is developed using the content, branding, and requirements provided by you.
Upon completion of the initial design, you will review the website.
Following design approval, a 30% payment is required.

STEP 4: Final Handover

Before the final website launch, domain connection, hosting setup, and transfer of files/credentials, the remaining 20% payment must be cleared.
Website ownership transfers only after full payment is received.

✦ 3. Payment Terms

50% Advance: After sample approval.
30% Milestone: After design approval.
20% Final: Before launch and handover.

All payments become non-refundable once development work has commenced. Payments for third-party services, domains, hosting, premium plugins, and software licenses are strictly non-refundable.

✦ 4. Delivery Timelines

Standard projects typically require 7–10 working days. However, timelines may vary based on the scope of work, custom functionalities, content availability, and client feedback times. Any delays caused by the client will automatically extend the project timeline.

✦ 5. Revision Limits

Each project package includes a maximum of 2 rounds of revisions.

Covered Revisions: Text edits, image replacements, minor styling, and minor layout changes.
Not Covered: Major redesigns, new pages, new features, functionality changes, or changes in project scope will require additional charges.

✦ 6. Testing Period

Following the final handover, Webmania provides a 7-day testing and support period.

Covered: Technical bugs, form issues, display issues, and broken links.
Not Covered: New features, design changes, and additional functionalities.

✦ 7. Client Responsibilities

The client is solely responsible for providing all necessary business information, logo files, images, text content, timely approvals, and feedback. Failure to provide required materials promptly may delay project delivery.

✦ 8. Ownership Rights & Intellectual Property

Client Ownership: The client retains full ownership of their text content, logos, images, and trademarks. Website ownership (the specific final instance of the site) transfers to the client only after full payment is received.
Webmania Ownership: Webmania retains full intellectual property rights to its internal frameworks, development methodologies, reusable code libraries, design systems, and proprietary assets.
Portfolio Rights: Webmania reserves the right to showcase completed projects in our portfolio and marketing materials unless a specific non-disclosure agreement is signed in writing.

✦ 9. Confidentiality

Both parties agree to keep all technical, business, and project-related information strictly confidential and not to disclose such information to any third party without prior written consent, except as required by law.

✦ 10. Third-Party Services, Website Hosting & SEO

Third-Party Services: We may use or recommend third-party tools, themes, plugins, and hosting providers. We are not responsible for the performance, terms, or failures of these third-party services.
Website Hosting: Webmania may assist with hosting setup, but hosting uptime, security, and maintenance are the responsibilities of the hosting provider.
SEO Disclaimer: While we provide Basic SEO Setup based on industry best practices, we do not guarantee specific search engine rankings or traffic, as Google algorithm updates are beyond our control.

✦ 11. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. Webmania disclaims all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

✦ 12. Limitation of Liability

Webmania shall not be held responsible for:

Client delays in providing content or feedback.
Hosting outages or domain provider issues.
Google algorithm updates or search engine ranking drops.
Loss of business, revenue, data, or opportunities.
Third-party software or integration failures.

Under no circumstances shall Webmania's maximum liability exceed the total amount paid by the client for the specific project in question.

✦ 13. Governing Law & Dispute Resolution

These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms, or the services provided by Webmania, shall be subject to the exclusive jurisdiction of the courts located in Delhi, India.
